Terms of Use.

The rules for using Frankly, including one-time deck purchases and the All-Access auto-renewing subscription.

1. Agreement

These Terms of Use (“Terms”) form an agreement between you and Farid Jafarli, an independent developer (“Frankly,” “we,” “us”), for your use of the Frankly iPhone application and its content (the “App”). By downloading, purchasing, or using the App, you accept these Terms. If you do not agree, do not use the App.

Your App Store license is also governed by Apple’s Standard Licensed Application End User License Agreement (“Apple Standard EULA”). If these Terms conflict with the Apple Standard EULA, the Apple Standard EULA controls to the extent required for App Store distribution. Mandatory consumer rights in your country are not limited by these Terms.

2. What Frankly provides

Frankly is a local-first library of authored conversation and reflection card decks. V1 works on one iPhone and does not provide accounts, matching, pairing, chat, or cloud synchronization. The first cards of a paid deck may be available as a free preview.

Frankly is intended to support conversation and personal reflection. It is not therapy, medical care, mental-health treatment, crisis support, legal advice, or a substitute for a qualified professional. Do not rely on the App in an emergency.

3. Eligibility and age

You must be legally able to accept these Terms. If you are below the age at which you can enter a binding agreement in your country, a parent or guardian must review and accept them for you. Some decks contain mature relationship or emotional themes and require confirmation that you are at least 16. Do not bypass an age gate.

4. App Store purchases

All digital purchases are made through Apple In-App Purchase. Apple processes payment and applies the price, currency, taxes, payment method, refund rules, and storefront terms shown at confirmation. Frankly does not operate an external checkout for digital deck content.

Individual decks and bundles

An individual deck or deck bundle is a one-time, non-consumable purchase. It does not renew automatically. The exact localized price and included content are shown before you confirm payment. Eligible purchases can be restored through “Restore purchases” in the App.

All-Access subscription

All-Access is an auto-renewing subscription that unlocks the current Frankly deck library and new decks made available to All-Access members during an active subscription. The purchase card shows the localized price and billing period before confirmation. The currently offered plan is billed annually unless the App Store purchase sheet clearly shows another period.

All-Access is intended to provide continuing value through access to a maintained and expanding deck library. We may add, revise, or retire individual decks, but will not remove access to a separately purchased non-consumable deck merely because the subscription catalog changes.

Restores, refunds, and billing help

Restoring purchases is free and does not create a charge. Apple controls billing and refunds. To request a refund, visit reportaproblem.apple.com. Deleting the App or local data does not cancel a subscription. If a purchase does not appear, first use Restore purchases, then visit Frankly Support.

5. Your content and privacy

You keep ownership of anything you write in the App. V1 stores written reflections locally. You are responsible for anything you choose to export or share through iOS and for having permission to share information about another person. Our data practices are described in the Privacy Policy.

6. License and intellectual property

Subject to these Terms and the Apple Standard EULA, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App and purchased content on Apple-branded devices you own or control under Apple’s Usage Rules. The App, card prompts, deck structures, visual design, trademarks, and software remain owned by Frankly or its licensors.

You may not copy, scrape, republish, sell, sublicense, publicly distribute, systematically record, reverse engineer, or create a competing dataset from the App or its card content, except where applicable law expressly permits it. Ordinary personal sharing using the App’s share feature is allowed.

7. Acceptable use

You agree not to use Frankly to violate law or another person’s rights; harass, coerce, threaten, discriminate against, or endanger anyone; bypass purchase, age, security, or access controls; disrupt the App; or upload malicious code. Participation in any prompt is voluntary. Respect another person’s decision to skip a card or stop.

8. Third-party services

Apple, RevenueCat, Expo, and optional diagnostic providers support parts of the App. Their services may be unavailable or governed by their own terms. Links to external services are provided for convenience; we do not control their content or decisions, including Apple refund decisions.

9. Changes and availability

We may update the App, content, prices for future purchases, or these Terms. Apple handles subscription price-change notices and any consent required by law. Material Terms changes will be identified by a new effective date and, when appropriate, an in-app or App Store notice.

We aim to keep the App available but do not guarantee uninterrupted operation, compatibility with every device or future iOS version, or permanent availability of free preview content. Purchased non-consumable access remains subject to Apple’s platform and restore availability.

10. Suspension and termination

You may stop using the App at any time. Your license may terminate if you materially violate these Terms or the Apple Standard EULA. Termination does not itself create a refund and does not remove obligations that by their nature survive, including ownership, disclaimers, and limits of liability.

11. Disclaimers

To the maximum extent permitted by law, Frankly is provided “as is” and “as available,” without warranties beyond those that cannot legally be excluded. Card prompts are general content, may not suit every relationship or circumstance, and do not guarantee any personal, relationship, health, or other outcome. Always use your judgment and skip content that feels unsafe or inappropriate.

12. Limitation of liability

To the maximum extent permitted by law, Frankly and its provider will not be liable for indirect, incidental, special, consequential, or punitive damages, lost data, lost profits, relationship disputes, or harm arising from voluntary participation in a prompt. Where liability cannot be excluded, it is limited to the greater of the amount you paid for the App during the previous 12 months or the minimum amount required by applicable law. Nothing excludes liability that cannot legally be limited.

13. Governing terms and disputes

These Terms are governed by the laws applicable where the developer is established, without depriving you of mandatory consumer protections in your place of residence. Before starting formal proceedings, please contact support so we can try to resolve the issue informally. Apple is not responsible for providing maintenance or support beyond its obligations under the Apple Standard EULA.
